We are not exagerating when we say the Guadia Civil in Spain and the Douanes / Gendarmerie in France are everywhere, pulling in vans by the hundreds. They wait at toll boths, petrol stations, borders, parking areas. Vans are easy targets as they are easily overloaded - it's easy money for them.
If you was to be stopped and even only say 200kg's over your weight limit, the fine could be in the thousands, and even if you was lucky, you'd be looking at a minimum of €400. And even though you are not running with a tachograph and privately transport your own belongings, you are still governed by drivers hours legislation and limited to 11 hours driving a day (2 x 11 hour days in a 7 day period) and 9 hours a day thereafter. Have an accident, and if they can work out you've been on the road more than 9 or 11 hours, you are in deep trouble and will be arrested and vehicle impounded. The authorites carry mobile weight pads so can weigh you roadside anywhere.
DVSA and other authorities are carrying out regular weight checks and are now targeting vans. Of over 3000 vans weighed roadside in the UK during 2015, over 85% were found to be overweight. The fines can be big. You will have to arrange for another vehicle to come out and take any excess weight from you.

THIS HIRE VAN WAS PHOTOGRAPHED BY US ON 29TH OCT ONBOARD A BRITTANY FERRIES BOAT AS WE DOCKED IN BILBAO. The renter opened the rear shutter doors to reveal the van wasn't even fully loaded!! - We pointed out to him how overloaded the van obviously was, but he was clueless and said he was told it was a 3500kg van. He seems shocked when we told him the payload, after deducting his weight, fuel, spare wheel etc - was probably significantly less than 1000kg - and he seemed really worried after we told him to watch out for the Guardia Civil as the fines would be huge!!!! I don't think he will be renting again and will steer others away from the idea! - More to the point though, he was putting his life and ALL OTHER MOTORIST LIVES AT RISK... Disgrace on you Way2go!
THE BACK TYRES OF THIS VAN WE'RE ACTUALLY RUBBING THE BODYWORK. AND AS HE PULLED AWAY, YOU COULD EVEN HEAR THE TYRES RUBBING.. EVEN LOADED, THERE SHOULD BE AT LEAST 2 TO 3 INCHES OF SPACE BETWEEN THE WHEEL AND THE BODY.. DOWNRIGHT DANGEROUS....
JUNE 2016 - BRIT MAN IN LIVERIED HIRE VAN GETS €900 FINE NEAR MURCIA FOR BEING 200KG, YES, Just 200kg overweight. It also cost him over €400 to call someone out to take the excess off the hire van and said the Guardia Civil / Police we're very rude and intimidating...
APRIL 2016 - Hire van targeted by thieves near Burger King, M50, near Madrid... An elderly couple had some bags and personal effects stolen from them when they were duped by a ruthless gang. The livered hire van kind of gave the game away, and made these people sitting ducks! In all - they lost well over £2000 of belonings and money and we're deeply distressed.
IN EARLY MARCH 2016 - A man gets stopped just outside Madrid in a hire van, lets call it a Y Hire A van!! - and was overloaded by around 400 kg. We agree this can be quite dangerous, but the fine of €4600 could be classed as rather steep. But you can't argue with the Guardia Civil (unless you are brave!) We will repeat - €4600.
SEPTEMBER 2016 - Driver gets stopped in UK Reg Hire Van mid France. €600 fine for being 180kg's overweight AND HE WAS MADE TO HIRE A VAN AND PUT ITEMS IN STORAGE BY THE GENDARMERIE....
So... How could someone be 400 kilo's overweight. It's easy. Especially in a very large van or Luton type van, as the payload is usually just below 1000 kg. But from this figure, you also need to deduct the driver and any passengers weight and the weight of the fuel - so really, you can only put around 700 kilo's of belongings on board. That's roughly, about 9 or 10 people. THINK ABOUT IT.... 40 boxes at 20 kilo's each and you are at the limit...
